1. Chief Justice
This Court has a Chief Justice of the rank of special appointment, who is in charge of all of the Court’s administrative affairs and serves as a Justice.
Each panel, comprised of a Presiding Justice and four Associate Justices, decides cases by majority. There was only one panel in 1949, but there are four panels now owing to the increasing caseload.
(2) Joint Conference of the Presiding Justices and Justices
Joint Conference of the Presiding Justices and Justices is held every month with the participation of the Chief Justice, and all Presiding Justices and Justices who are currently holding posts and hearing cases. The Chief Justice acts as the Chairperson. It is a statutory mechanism that functions as the en banc court to maintain the uniformity of legal opinions in this Court.
(1) Committee for the Compilation of Precedents
Pursuant to §16 of the Organic Law of the Administrative Court and §4 of Supreme Administrative Court Regulations on the Compilation and Change of Precedents, the Chief Justice designates a few Presiding Justices and Justices to form a Committee for the Compilation of Precedents. The Committee preliminarily scrutinizes the judgments that are selected by panels of this Court for their precedential value, and makes reports upon which the Joint Conference of the Chief Justice, Presiding Justices, and Justices decides whether these judgments may become precedents. If it is necessary to change or abolish the existing precedents, the same procedure is utilized.
(2) Committee for State Compensation Cases
In order to handle state compensation cases claimed by individuals in accordance with the State Compensation Law, Supreme Administrative Court Regulations on the Handling of State Compensation Cases prescribes a five- member Committee for State Compensation Cases, dealing with the investigation, negotiation, litigation, and claims of state compensation cases.
(3) Committee for the Self-Discipline of Justices
Pursuant to the Court Regulations for the Self-Discipline of Judges and Justices at all levels, this Court has a Committee for the Self-Discipline of Justices, dealing with matters relating to the self-discipline of Justices in order to preserve the integrity, professional ethics and reputation of Justices.
(4) Committee for the Evaluation of Positions
Pursuant to §8 of the Regulations Governing the Evaluation of Positions, the court has a Committee for the Evaluation of Positions which is responsible for the preliminary evaluation of the position of judges by examining the actual facts based on the principle of fairness and justice.
(5) Committee for the Evaluation of Performance
Pursuant to §15 of the Civil Servant Performance Evaluation Act, this Court has a Committee for the Evaluation of Performance to make annual merit rating, special merit rating and the preliminary and final evaluation of the regular assessments of the staff for rewards or disciplines.
(6) Screening Committee
Pursuant to §8I of the Civil Servant Promotion Act, the Screening Committee is formed. The Court’s employee-screening (selection) related affairs are processed through an open, fair, and just manner on the principle of internal promotion and external hiring.
Administrative matters of this Court are dealt with by Clerical Bureau, Personnel Office, Accounting Office, Statistics Office, Government Ethics Office, and Information Technology Office respectively under the supervision of the Chief Justice. The Chief Clerk, the head of the Clerical Bureau, is responsible for conducting administrative affairs on the orders of the Chief Justice, as well as overseeing all work within the Clerical Bureau. The Clerical Bureau consists of subordinate Sections, such as Clerk’s Sections, Procedural Examination Section, Document Section, Research and Evaluation Section, and General Affairs Section. Each Section is led by a director. Also working in the Clerical Bureau are several bailiffs and judicial assistants.
